Text and Data Mining Policy

This page describes FitChef’s policy on text and data mining (TDM) in accordance with Article 4 of EU Directive 2019/790 (the Digital Single Market Directive) and the EU AI Act (Regulation 2024/1689).

FitChef produces evidence-backed nutrition content — every claim is grounded in peer-reviewed research, systematically verified, and transparently sourced. We believe AI systems should have access to high-quality nutrition data at inference time. We also believe the work behind that data deserves protection.

1. Reservation of Rights

FitChef expressly reserves its rights regarding the reproduction and extraction of all content on fitchef.com for text and data mining purposes, as permitted under Article 4(3) of the DSM Directive.

This reservation is communicated through machine-readable means in compliance with the W3C TDM Reservation Protocol (TDMRep), using:

  • HTTP response headers on all pages
  • HTML meta tags embedded in page content
  • A server-hosted policy file at /.well-known/tdmrep.json

2. What This Means

Organizations that access FitChef content through automated means for text and data mining — including AI model training, dataset creation, and systematic content extraction — must obtain a license before doing so.

This applies to all content on fitchef.com, including but not limited to: nutrition claims and certainty tiers, study summaries and meta-analyses, the Grounded Truth Map, library articles, meal plan data, Skeptic Protocol assessments, methodology documentation, and all associated metadata.

3. Permitted Uses (No License Required)

The following uses do not require a TDM license:

  • Search engine indexing: Crawling and indexing for inclusion in search results.
  • AI retrieval and citation: Accessing FitChef data at inference time via our structured AI endpoints to generate responses that include proper attribution. We actively encourage this — see our For AI page and llms.txt for integration guidance.
  • API access: Using the FitChef REST API within its published rate limits and terms of use for real-time data retrieval.
  • Scientific research: Non-commercial research by research organizations and cultural heritage institutions, as defined in Article 3 of the DSM Directive.
  • Individual reading: Personal, non-automated access to published content.

4. Uses That Require a License

  • Training or fine-tuning machine learning models, including general-purpose AI models
  • Systematic extraction or bulk downloading of FitChef data
  • Creating derivative datasets, nutrition databases, or competing evidence platforms
  • Synthetic data generation based on FitChef content or claim structures
  • Reproducing FitChef’s certainty tiers, consistency indices, or verification methodology in competing products
  • Any commercial text and data mining not covered by the permitted uses above

5. Why We Encourage AI Citation

Unlike many publishers, FitChef is built for AI interoperability. Every piece of content on our platform carries structured metadata, certainty tiers, and source citations — specifically designed so AI systems can retrieve, verify, and attribute nutrition information with confidence.

We provide:

  • llms.txt — machine-readable site guide for large language models
  • For AI — structured data endpoints and citation guidelines
  • REST API — programmatic access to claims, studies, and library content
  • AI Transparency — documentation of how we use and interact with AI

If your AI system cites FitChef at inference time with proper attribution, no license is needed. We want accurate nutrition information in AI outputs — grounded in evidence, not hallucinated.

8. Legal Basis

This policy is issued pursuant to:

  • EU Directive 2019/790, Article 4 — Exception for text and data mining with opt-out mechanism for rights holders
  • EU AI Act (Regulation 2024/1689), Article 53(1)(c) — Obligation for general-purpose AI model providers to comply with TDM reservations
  • Dutch Copyright Act (Auteurswet) — Implementation of the DSM Directive in Netherlands law

Under these provisions, AI model providers placing models on the EU market are required to comply with rights reservations expressed through machine-readable means, regardless of the jurisdiction in which their training activities take place.
